This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)

Drawing on the natural-resource-based view, we propose that employee stakeholder integration is linked to environmental performance through firms’ proactive environmental strategies, and that this link is contingent on shared vision. We tested our model with a cross-country and multi-industry sample. In support of our theory, results revealed that firms’ proactive environmental strategies translated employee stakeholder integration into environmental performance. This relationship was pronounced for high levels of shared vision. Our findings demonstrate that shared vision represents a key condition for advancing (...) the corporate greening agenda through proactive environmental strategies. We discuss implications for the CSR and the environmental management literatures, with a particular focus on the NRBV and stakeholder integration debates. (shrink)

El artista chileno José Miguel Blanco tuvo un rol protagónico en la escena cultural del país durante la segunda mitad del siglo XIX. Aparte de su labor escultórica, traducida en una cantidad importante de obras, una buena parte de su quehacer estuvo vinculado con la escritura de arte, lo que se materializó, principalmente, en el periódico El Taller Ilustrado, el primer medio informativo en el país dedicado exclusivamente a temas de arte, que este escultor creó y dirigió por casi (...) cinco años. Desde esa tribuna Blanco promovió información, debates e iniciativas que favorecieron el desarrollo cultural del país. Este escultor es, sin lugar a dudas, el autor más prolífico en la escritura artística chilena de su tiempo. The Chilean artist José Miguel Blanco had a protagonic role in the culture scene in the country during the second half of the 19th century. Besides his works of sculpture, reflected in an important quantity of pieces of art, a great part of his work was related to the Artistic Writing, which was materialized, mainly in the newspapers called El Taller Ilustrado, the first informative media in the country dedicated exclusively to the topics of Art, that this sculptor created and managed for almost five years. From this tribune, Blanco promoted information, debates and initiatives that contributed to the development of culture in Chile. The sculptor is, without any doubt, the most prolific author in Chilean Artistic Writing in his time. (shrink)

Este artículo establece relaciones entre el mensaje de algunos manuales de Historia del bachillerato franquista, utilizados como fuentes primarias (29 en total) y la posición política de sus autores, fueran castigados (depuración en el escalafón de catedráticos de 1935), o premiados con la convocatoria de oposiciones patrióticas de 1940 que favorecieron a los simpatizantes del golpe de Estado de 1936. Para descubrir esas trayectorias personales se recurre a fuentes secundarias. Si unos autores utilizan el manual de Historia para constatar su (...) fidelidad personal al régimen de Franco; otros, lo utilizan como salvoconducto, para marcar distancias con su pasado masón, republicano de izquierdas, catalanista. Si en autores como José Ramón Castro hay coherencia entre su producción historiográfica profesional y escolar (su fidelidad al régimen es inquebrantable), Jaime Vicens Vives o Antonio Domínguez Ortiz, como autores de manuales representan la cultura oficial (legitiman al régimen); como historiadores profesionales, la denominada cultura establecida, al distanciarse más de él y de sus valores. In this paper I propose to conceive of forgiveness as a process of eliminating punitive reactive attitudes, which makes up part of the offended person’s willingness to reestablish a certain type of reciprocal relationship with the offender. Distinguishing among types of reciprocity allows us to realize that forgiveness is a more varied phenomenon than is usually assumed in the philosophical literature, as well as to understand why the dispute concerning the gratuitousnessconditionality of forgiveness is meaningless.

Este artigo tem por objetivo investigar como Michel Foucault e Roland Barthes analisaram a obra dos pintores Édouard Manet e Cy Twombly guiados pela idéia de que, na modernidade, a obra de arte não pode mais ser interpretada meramente como a expressão da subjetividade de seu autor e, sim, em virtude da relação que ela mantém com a cultura e com a história da arte anterior a ela, bem como o de avaliar o quanto esta abordagem se aproxima do formalismo.

The current study analyzed the relationship between Coronavirus Awareness, mental health, and willingness to seek professional psychological help. This was made through a quantitative approach, using online questionnaires to collect data from 855 subjects. The questionnaires included the Brief Symptom Inventory to measure mental health indicators, the Attitudes Toward Seeking Professional Psychological Help Scale–Short Form, and the Coronavirus Awareness Scale-10. An Exploratory Factor Analysis suggests that three factors underlie the CAS-10: Coronavirus Concern, Exaggerated Perception, and Immunity Perception. Results indicate a (...) significant positive correlation between Coronavirus Concern and both general anxiety and phobic anxiety symptoms. Immunity Perception is positively related to paranoid ideation and psychotic symptoms. A Mediation Analysis determined that Coronavirus Concern has a significant positive direct effect on Openness to Seeking Psychological Treatment, while Exaggerated Perception and Immunity Perception scores have significant direct negative effects on the Value and Need in Seeking Treatment scores. Indirectly, the relationship between Coronavirus Concern and OPST is significantly mediated by anxiety symptoms. Similar results were found for the VNST subscale. There is a negative significant effect of Immunity Perception over OSPT mediated by Paranoid Ideation. However, the overall model only achieved small r2 coefficients for the OSPT and VNST scores. Comparisons in Coronavirus Awareness between sex, age, and the presence of children and older adults at home were also made. These results are discussed regarding their practical implications for mental health providers and policymakers. (shrink)

ABSTRACT: So far in this book, we have examined algorithmic decision systems from three autonomy-based perspectives: in terms of what we owe autonomous agents (chapters 3 and 4), in terms of the conditions required for people to act autonomously (chapters 5 and 6), and in terms of the responsibilities of agents (chapter 7). -/- In this chapter we turn to the ways in which autonomy underwrites democratic governance. Political authority, which is to say the ability of a government to exercise (...) power, may be justifiable or not. Whether it is justified and how it can come to be justified is a question of political legitimacy. Political legitimacy is another way in which autonomy and responsibility are linked. This relationship is the basis of the current chapter, and it is important in understanding the moral salience of algorithmic systems. We will draw the connection as follows. We begin, in section 8.1, by describing two uses of technology: crime predicting technology used to drive policing practices and social media technology used to influence elections (including by Cambridge Analytica and by the Internet Research Agency). In section 8.2 we consider several views of legitimacy and argue for a hybrid version of normative legitimacy based on one recently offered by Fabienne Peter. In section 8.3 we will explain that the connection between political legitimacy and autonomy is that legitimacy is grounded in legitimating processes, which are in turn based on autonomy. Algorithmic systems—among them PredPol and the Cambridge Analytica-Facebook-Internet Research Agency amalgam—can hinder that legitimation process and conflict with democratic legitimacy, as we argue in section 8.4. Algorithmic systems and predictive analytics play an increasingly important role in various aspects of modern life. Scholarship on the moral ramifications of such systems is in its early stages, and much of it focuses on bias and harm. This paper argues that in understanding the moral salience of algorithmic systems it is essential to understand the relation between algorithms, autonomy, and agency. We draw on several recent cases in criminal sentencing and K–12 teacher evaluation to outline four key ways in (...) which issues of agency, autonomy, and respect for persons can conflict with algorithmic decision-making. Three of these involve failures to treat individual agents with the respect they deserve. The fourth involves distancing oneself from a morally suspect action by attributing one’s decision to take that action to an algorithm, thereby laundering one’s agency. (shrink)

These notions are then formally charac- terized by extending the DOLCE foundational ontology. Este estudo tem como objetivo geral discorrer de forma sucinta e crítica sobre os principais desafios enfrentados pelas pessoas negras, em especial as mulheres, na sociedade brasileira. E como objetivos específicos, analisar, a partir da concepção do feminismo, as problemáticas que englobam o racismo, sexismo, democracia racial, estética do racismo e como estes também acabam servindo de base para o justificar o epistemicídio da intelectualidade negra feminina, no qual esses desafios são herdados de opressões do colonialismo imposto ao território brasileiro. Com isso, dissertaremos também a respeito de diversas categorias dessas opressões, e como elas se relacionam ao cenário político cultural brasileiro e de que maneira essas opressões atingem, em específico, os corpos das mulheres negras, que sofrem um processo constante de epistemicídio e sexualização extrema. Por fim, este trabalho tem como apoio teórico o pensamento da filósofa Lélia Gonzalez, que percebe na criação de um espaço de beleza negra feminina, que suas vozes podem ser ouvidas e sua filosofia exaltada. This paper establishes a structural typology of the organisational configurations of public research organisations which vary in their relative internal sharing of authority between researchers and managers; we distinguish between autonomous, heteronomous and managed research organisations. We assume that there are at least two sources of legitimate authority within research organisations, one derived from formal hierarchy and another derived from the research community ; the balance of authority between researchers and managers is essentially structural but is empirically mediated by the (...) funding portfolio of organisations and the corresponding endowment of resources at the disposal of leaders or researchers. Changes in the level, sources and strings of organisational and individual research funding are expected to affect the balance of internal authority in different ways depending on the organisational configuration, and to open the door to the influence of external actors in the development of research agendas.
